Customs benefits for MREs in Morocco do not constitute a general exemption allowing a car to be imported free of charge. Two procedures must be distinguished from the outset. Temporary admission applies to an MRE who maintains their habitual residence abroad and comes to stay in Morocco. Transfer of residence applies to a person settling permanently in the Kingdom. In the first case, duties and taxes are suspended, but the vehicle must be re-exported. In the second case, personal effects may qualify for an exemption, while the car is subject to separate rules.
The central legal text is the Customs and Indirect Taxes Code, promulgated by Dahir enacting Law No. 1-77-339 of 25 Shawwal 1397, corresponding to October 9, 1977, as regularly amended. Articles 145 et seq. govern the temporary admission of items brought in by persons whose habitual residence is abroad. Decree No. 2-77-862 of October 9, 1977, implementing the Code supplements this framework. Practical arrangements are specified by the regulations and instructions of the Customs and Indirect Tax Administration.
In practical terms, a temporarily admitted vehicle remains under customs supervision. The suspension notably covers import duty and value-added tax on importation. It does not extinguish the potential customs debt: that debt becomes payable again if the vehicle is sold, abandoned, used improperly, or kept in Morocco after the deadline expires. Leaving the country for a few days does not automatically reset the clock, because the authorized period is monitored over the entire calendar year.
Permanent return primarily provides an exemption for used household goods and personal effects corresponding to a genuine transfer of residence. In 2026, there is no full and automatic exemption for every car belonging to an MRE returning permanently. Certain MREs who are at least 60 years old and have actually resided abroad for at least ten years may apply for a specific 90% reduction based on the vehicle’s value when new, within the applicable regulatory limit. This mechanism remains permanent customs clearance, not temporary admission.
Beware of outdated information circulated on social media. Finance Law No. 55-23 applies to the 2024 budget year, not 2025. Finance Law No. 60-24 applies to the 2025 budget year. For 2026, you must consult the text published in the Official Gazette and the customs tariff applicable on the date the declaration is registered. An announcement concerning electric vehicles never amounts to an individual exemption decision.
For temporary admission, the decisive criterion is habitual residence abroad. Moroccan nationality is not sufficient. A Moroccan whose permanent home, main activity, and administrative ties are in Morocco does not become a non-resident merely because they hold a foreign visa or travel regularly. Conversely, dual nationality does not disqualify a person from the procedure if they establish that they legally and habitually live outside the Kingdom.
Proof generally consists of a valid foreign residence permit, an identity card issued by the country of residence, a long-stay visa, or a foreign passport. If there is any doubt, customs may request a certificate of residence, employment contract, payslips, tax assessment, lease, or consular registration certificate. No single document guarantees acceptance. Officers assess the consistency of the file, previous entries and exits, and the applicant’s actual circumstances.
There is no general requirement that every car placed under temporary admission must have belonged to the MRE for six months. This period is often confused with the transfer-of-residence rules applicable to previously used goods. For temporary admission, the registration certificate must normally correspond to the declarant. If the vehicle belongs to a company, spouse, lending institution, or rental agency, a power of attorney, rental agreement, or authorization for use may be required.
The driver must personally enter Morocco and complete the vehicle declaration, except in a situation accepted and documented by customs. The vehicle may arrive by ferry with its holder or be presented under a procedure approved in advance. You should not ship a car separately on the assumption that it will automatically be granted the tourist procedure. Importation as freight, without a traveler who meets the conditions, is in principle subject to a different customs procedure.
A foreign spouse may benefit from temporary admission if they habitually reside outside Morocco and personally satisfy the conditions of the procedure. A Moroccan civil servant posted abroad, a student, or a retiree must also prove actual residence outside the Kingdom. In practice, the temporary nature of a professional or university stay does not necessarily prevent admission, but an ambiguous file warrants written confirmation from the customs office before departure.

Before traveling, check the validity of your passport, residence permit, registration certificate, and insurance. An electronic advance declaration may be offered by the customs services to speed up clearance, but it replaces neither presentation of the vehicle nor inspection at the border. Print the reference obtained or save it offline. Digital procedures may change between summer seasons; the MRE section of the institutional portal affiliated with the Ministry of Finance should therefore be consulted immediately before departure.
At Tanger Med, Nador, Casablanca, or a land border crossing, the driver presents the vehicle at the customs counter with the original documents. The officer checks the driver’s identity, non-resident status, registration, chassis number, and previously recorded admissions. A temporary admission declaration is then issued. Depending on the system in operation, proof may take the form of an admission document, an electronic reference, or an entry linked to the holder’s passport.
Immediately review the information entered. An error in the registration number, chassis number, make, or holder’s identity may prevent exit several months later. Request correction at the point of entry before leaving the customs area. Keep a legible photograph of the declaration, passport, and registration certificate in a secure location. If your passport is lost, report it promptly to the police, the competent consulate, and the customs office without waiting until your departure.
Once admitted, the vehicle may not be sold, given away, rented out, dismantled, or used for a commercial activity without authorization and prior regularization. It must retain its foreign registration and insurance valid in Morocco. The holder remains liable to customs even when another person is actually driving the car. Authorized family members must be able to present their own proof of residence abroad and, as a precaution, authorization from the holder.
Upon exit, present the same vehicle and the admission documents for customs inspection. Check that the re-exportation has been properly recorded before leaving the checkpoint. A ferry ticket, toll receipt, or police stamp alone does not always prove that the procedure has been closed in the computer system. If the admission remains open by mistake, promptly submit a correction request to the exit office, together with the boarding pass, vehicle documents, and any evidence that the vehicle is abroad.
The basic file includes the passport used for entry, proof of lawful residence abroad, and the original registration certificate. The surname, given names, and date of birth must be consistent across all documents. A difference resulting from marriage, Arabic-Latin transliteration, or a compound given name may lead to an in-depth inspection. In that case, bring a marriage certificate, birth certificate, or administrative certificate establishing that the documents concern the same person.
The registration certificate must be valid and make it possible to identify the date of first registration, the owner, and the chassis number. For a leased vehicle, company-owned vehicle, or vehicle lent by a spouse, attach the owner’s original authorization. It must permit the vehicle to leave the country of registration and be used in Morocco. Some leasing companies expressly prohibit travel outside the European Union, even if the driver physically holds the registration certificate.
Third-party liability insurance is mandatory. The international motor insurance card must list Morocco among the countries covered, without the corresponding country code being crossed out. Otherwise, frontier insurance may be purchased from an approved insurer. Rates are not set by customs: in 2025-2026, observed offers vary considerably depending on the period, vehicle category, and coverage. Request a written quotation, because a generic estimate of 600 to 2,500 dirhams per month does not constitute an official tariff.
Documents written in French or Arabic are the easiest to process. Standardized European registration certificates and titles in Spanish, Italian, Dutch, German, or English are commonly encountered at borders, but customs may request a translation if a decisive entry remains unclear. For a complex power of attorney or a non-standard document, a translation prepared by a sworn translator reduces the risk of rejection. Keep the original and a copy, as the translation does not replace the foreign title.
Foreign roadworthiness certificates and conformity documents may be useful, especially when permanent customs clearance and Moroccan registration are contemplated. However, they replace neither insurance nor the customs declaration. For a permanent return, add evidence that foreign residence has ended, an inventory of personal effects, proof of how long the goods have been owned and, where applicable, the documents required for the benefit granted to older MREs. Have the entire file scanned before traveling.
The operational rule applied to passenger vehicles placed under temporary admission is a maximum period of 180 days per calendar year, in one or more periods. It is often referred to as six months, but it is more prudent to calculate based on the days recorded by Customs. The period begins on the date of admission. A vehicle used for four months in the spring and then brought back in the summer does not therefore automatically qualify for another six months.
The change of calendar year should be checked with the customs office, as it does not turn an admission into an unlimited right to keep the vehicle in Morocco. Repeated entries and exits, the holder’s prolonged absence, or regular use by a person residing in Morocco may lead to an inspection. Before planning a stay spanning two years, request confirmation from the competent office by providing the registration number and the dates already used.
An extension may be considered in the event of serious illness, an accident, a breakdown rendering the vehicle immobile, or another event beyond the holder’s control. It is never automatic. The application must be filed before expiry, together with a medical certificate, expert report, garage invoice, or evidence of force majeure. Processing times are often five to fifteen business days when the file is complete, but this range reflects office practice and is not a guaranteed statutory period.
If the MRE must leave without the vehicle, they must not simply leave it in a family garage. Customs must be contacted before departure to determine the accepted solution: placement under customs control, storage at an authorized location, supervised immobilization, or exceptional authorization. The arrangements depend on the circumstances and the office. Leaving by plane without making a declaration keeps the temporary admission open and may require the holder to explain how the vehicle was used during their absence.
Re-exportation within the prescribed period is the normal solution. If the owner ultimately wishes to keep or sell the vehicle in Morocco, they must apply for its release for home use, obtain customs approval, verify its technical eligibility, and pay duties and taxes before any transfer. The calculation depends on the assessed value, age, origin, engine type, and applicable tariff. A verbal estimate given at the port is not a customs clearance certificate.
The transfer of residence must correspond to genuine settlement in Morocco. Customs looks for the termination or lasting reduction of residential ties abroad: consular deregistration where issued, termination of an employment contract, retirement, lease termination, sale of the home, or a change-of-residence certificate. No single document is universally decisive. An MRE who retains their primary home and employment abroad must not declare a permanent return solely to obtain an exemption.
Clothing, books, furniture, household appliances, and other personal items that have already been used may be imported duty-free when they correspond to the household’s normal needs and are not commercial in nature. Prepare a detailed, dated, and signed inventory stating the number of boxes, the nature of the goods and, for appliances, the relevant references. Multiple new goods, business stock, alcohol, tobacco, and goods subject to special regulations do not become personal effects merely because they are included on the list.
The goods must be imported within the time limits and under the arrangements accepted for the transfer of residence. When they arrive in several shipments, ensure that this is noted on the first declaration and retain the endorsed inventory. Based on practices observed in 2025-2026, a removal company or customs broker may charge approximately 1,500 to 5,000 dirhams to process a standard file, excluding transport, storage, handling, and taxes. Request an itemized quotation, as these fees are not governed by a single customs tariff.
A vehicle is excluded from the ordinary exemption granted to household goods. It must normally undergo customs clearance based on its value and the applicable tariff. The best-known benefit concerns an MRE who is at least 60 years old and can prove at least ten years of actual residence abroad. Subject to technical and administrative conditions, they may apply for a 90% reduction applied to the passenger vehicle’s new value, with that value capped at 300,000 dirhams for calculating the benefit.
This allowance is granted only once and does not mean that the beneficiary will pay exactly 10% of the purchase price. The customs basis, remaining taxes, the 300,000-dirham limit, and any excess value affect the final amount. The vehicle must comply with Moroccan importation and registration rules. Before purchasing it, obtain a written estimate based on the chassis number, date of first registration, power rating, and invoice.
For an electric or hybrid vehicle, temporary admission operates in the same way as for an internal-combustion vehicle: it suspends duties during the stay, without any additional MRE benefit linked to the powertrain. For permanent importation, the tariff may differ depending on the customs nomenclature and the budgetary measures in force. There is no rule under which every electric vehicle belonging to an MRE is fully exempt. The 2026 tariff must be checked on the date of the declaration.
Exceeding the permitted period, failing to re-export, or using the vehicle contrary to the conditions of temporary admission constitutes a customs offence. The Customs Code classifies acts according to their nature and seriousness, particularly in its provisions relating to disputes and offences. There is no single fixed fine applicable to all overstays. The amount depends on the vehicle’s value, the duties at stake, the duration, the holder’s conduct, and whether a transfer or fraudulent act may have occurred.
A sale, gift, or rental to a Moroccan resident without prior customs clearance is far more serious than a delay of a few days that is voluntarily regularized. Customs may seize the vehicle, claim duties and taxes, draw up an official report, and seek the fines prescribed for the applicable classification. The buyer or driver may also be prosecuted if they knew of the vehicle’s irregular origin. No private agreement, even if officially authenticated, regularizes a vehicle that is still under temporary admission.
Estimates sometimes circulated, ranging from 30,000 to 150,000 dirhams for a vehicle valued at 300,000 dirhams, do not constitute an official scale. In some cases, the total liability may exceed this range because of duties, VAT, fines, storage, and immobilization. Demand a written statement specifying the customs value, the duties at stake, the classification of the offence, and the provisions applied. Do not pay any amount without an official receipt.
Article 273 of the Customs Code allows the Administration to enter into settlements under the conditions prescribed by law. A customs settlement may end the dispute or reduce uncertainty, but it is neither automatic nor necessarily advantageous. Before signing it, verify the acknowledged facts, the amount, what will happen to the vehicle, and the consequences of waiving rights. A settlement that has been accepted and performed generally precludes most challenges relating to the facts concerned.
When an official report leads to prosecution for a customs offence, the territorially competent Court of First Instance hears the criminal proceedings, depending on the applicable classification and procedural rules. Depending on its subject matter, a separate administrative decision, refusal, or recovery issue may fall within the jurisdiction of the administrative court. Appeal periods are not identical. Upon receiving a seizure order, notification, or enforcement notice, send the entire file to a lawyer without delay.
The most common mistake is to confuse temporary suspension with permanent exemption. The second is to leave the vehicle with a relative residing in Morocco after returning abroad. A resident must not regularly use a vehicle under temporary admission as though it belonged to them. Any family exceptions or potential authorizations are interpreted strictly and require evidence. A handwritten power of attorney does not change the vehicle’s customs status.
In the event of theft, immediately file a complaint with the police or Royal Gendarmerie and notify the customs office handling the admission. Submit the complaint receipt, official report number, registration certificate, and entry declaration. Theft does not automatically close the procedure: Customs must regularize the re-exportation obligation in light of the investigation and supporting documents. Also notify the insurer within the contractual time limit, which is often much shorter than the customs deadline.
After an accident resulting in total destruction, do not have the wreck dismantled or sold without approval. A police report, insurance assessment, photographs, and destruction certificate may be required. If the wreck can be exported, Customs may require its re-exportation; if it must be destroyed in Morocco, the operation must be supervised or authorized. A mechanical breakdown, even an expensive one, does not necessarily constitute force majeure and does not extinguish the duties owed.
If the holder dies, the heirs must notify Customs and provide the death certificate, vehicle documents, and inheritance documents. They may neither sell nor divide the vehicle before its customs status has been regularized. The same caution is required when the MRE loses non-resident status by settling in Morocco: temporary admission does not automatically become permanent importation. A declaration must be filed before any long-term use.
A lawyer practising customs law begins by checking the admission declaration, border-crossing history, official report, assessed value, and legal classification. The lawyer may submit observations, apply for an extension or regularization, negotiate a settlement, and initiate the appropriate appeal. However, the lawyer cannot guarantee release or erase an established offence. Legal assistance is particularly useful before signing an official report, acknowledgment of debt, or settlement.
In 2026, digitalization facilitates certain formalities, but it does not replace physical inspections or original supporting documents. Before each trip, consult the official communications of the Ministry of Economy and Finance and notices intended for MREs. During July and August, allow substantial extra time at Tanger Med and other ports. Arriving early, retaining copies, and immediately correcting an error remain more effective than seeking regularization several months later.
