How is an inheritance computed under the Moudawana?

Book VI of the Moudawana (law No. 70-03) codifies Maliki succession rules. The net estate is determined first (after debts, funeral costs and bequests within the third), then the fixed shares (fard) are served — spouse, mother, daughters, sisters — and the residue goes to the ʼasaba heirs: sons (double a daughter’s share), father, then brothers.

Two corrective mechanisms apply automatically: 'awl abates all shares proportionally when they exceed the estate, and radd (article 353) returns the surplus to fixed-share heirs — spouse excepted — when there is no residuary heir.

Mind the exclusions (hajb): the father excludes all the deceased's siblings; children exclude uterine siblings; and the sibling headcount — even excluded ones — can reduce the mother from 1/3 to 1/6.

When the simple computation is not enough

Grandchildren of a predeceased son (mandatory bequest), grandparents, wills, missing heirs, ongoing pregnancy, heirs of different nationalities or faiths: these cases leave the standard computation and require legal analysis. Likewise, the actual partition — especially with co-owned real estate — raises questions (auction, balancing payment, inheritance deed) where a lawyer saves years of deadlock.

The simulator flags these limits: if your situation falls under them, treat the result as an order of magnitude and have the partition validated by a professional.

What is the widow's share in Morocco?
The surviving wife receives 1/8 of the estate if the deceased leaves children, 1/4 otherwise. Several wives share that portion equally.
Does a daughter inherit half of a son?
Yes: when they inherit together as 'asaba, a son takes double a daughter's share (article 351). An only daughter with no brother takes a fixed 1/2; two or more daughters share 2/3.
Who inherits when there are no children?
The spouse (1/2 for a husband, 1/4 for a wife), the parents, and failing a father the siblings by their tie (full, paternal, uterine). With no heir at all, the estate escheats to the State treasury.
Does the simulator replace the inheritance deed?
No. The adoul-drawn inheritance deed remains indispensable to prove heirship, and only a lawyer can secure a contested partition. The simulator gives the theoretical shares to prepare those steps.
