Severance is expressed in hours of salary per year of seniority — any started year counts in full. The hourly value is the monthly salary divided by 191 (legal working time: 44 h/week).

How is severance pay calculated?

Any permanent employee with at least six months of seniority is entitled to severance pay, except in cases of serious misconduct (articles 52 and 61). Article 53 sets a progressive scale in hours of salary: 96 hours per year for the first five years, 144 hours for years 6–10, 192 hours for years 11–15 and 240 hours beyond.

The basis is the average salary of the 52 weeks before termination, bonuses and benefits included (article 57). Example: with an average monthly salary of MAD 8,000 and 10 years of seniority, legal severance reaches 1,200 hours — about MAD 50,260 — plus 2 months of notice (MAD 16,000).

For employee delegates and union representatives, the legal indemnity is doubled (article 58).

Unfair dismissal: up to 36 months of salary

If the dismissal lacks a valid reason — or the procedure was not followed — the court can award damages on top of legal severance and notice: one and a half months of salary per year of seniority, capped at 36 months (article 41).

This is usually where the real money is: for 10 years at MAD 8,000, damages can reach MAD 120,000 — more than double the legal severance. Whether a dismissal is unfair is a legal question worth an assessment by a labor law attorney.

Serious misconduct and resignation: no severance

Serious misconduct deprives the employee of severance and notice (article 61) — but courts strictly control that qualification: a "serious misconduct" dismissal requalified as unfair opens the right to all indemnities. Resignation carries no severance and requires a legalized signature (article 34).

Severance paid within the legal limits is exempt from income tax, as are court-awarded damages within the article 41 ceiling.
