Civil Servant Transfers and Assignments in Morocco: Complete 2026 Guide
This guide helps you assess the lawfulness of a transfer, preserve your deadlines, and choose between an administrative appeal, a stay of execution, and an action for annulment.
What Moroccan law says about transfers and assignments
Morocco civil servant transfer law
Transfers are governed mainly by Dahir No. 1-58-008 of 24 February 1958 and the special statute applicable to the relevant corps.
Article 64 Civil Service Statute
Article 64 governs compulsory transfers and requires the opinion of the Joint Administrative Committee when the transfer entails a change of residence.
definition of compulsory transfer
A compulsory transfer is a transfer decided unilaterally by the administration, in principle to meet service requirements.
difference between assignment and transfer
An assignment places the employee in a post, whereas a transfer generally changes the employee’s department or place of work.
transfer as disguised disciplinary action
A transfer becomes disguised disciplinary action when its true purpose is punitive and the disciplinary procedure is not followed.
The transfer of a Moroccan civil servant is governed first by Dahir No. 1-58-008 of 24 February 1958 establishing the General Civil Service Statute, subject to the special statute applicable to the civil servant’s corps. The key provision is Article 64: the administration may order the compulsory transfer of a civil servant, but the opinion of the Joint Administrative Committee is required when the transfer entails a change of residence. The same article also requires family circumstances and seniority to be considered in transfer requests, within the limits of service requirements.
In practical terms, an assignment generally means the initial appointment or placement in a position corresponding to the employee’s grade. A transfer subsequently changes the place or department of employment, normally without changing the employee’s grade or corps. Mobility between two administrations may require matching decisions, integration, secondment, or another statutory mechanism. The title given to the document is not decisive: the court examines its actual effects on residence, duties, remuneration, and administrative status.
The power to transfer is therefore not unlimited. The decision must serve the interests of the service, be made by the competent authority, and comply with both the General Statute and the special statute applicable to the relevant corps. A transfer cannot be used to impose, without disciplinary safeguards, a penalty that does not appear in the scale set out in Article 66 of the General Statute. Particular attention must also be paid to corps excluded or partially exempted from the General Statute by Article 4 thereof, especially where a special statute itself governs appointments and transfers.
Conditions for the lawfulness of a civil servant transfer
authority of transfer decision signatory
The decision must be signed by the authority vested with the power of appointment or by a duly authorised delegate.
Joint Administrative Committee transfer
Its opinion is required under Article 64 when a compulsory transfer entails a change of residence.
reasons for transfer decision
The requirement to provide written reasons depends on Law No. 03-01 and the true nature of the measure, particularly whether it is disciplinary or derogatory.
service interests and transfer
The transfer must meet a genuine service need and not be based on a reason unrelated to the proper functioning of the service.
civil servant transfer notice period
There is no single general notice period for all corps; starting dates depend on the applicable statute and the decision.
The first issue to verify is the signatory’s authority. A minister, head of administration, academy director, or territorial authority may act only within the limits of the applicable legislation and duly published delegations. You should therefore obtain the complete decision, identify the signatory, and locate the order delegating signature authority. A mere verbal instruction, electronic message, or internal memorandum may reveal the existence of a decision, but the absence of an identifiable instrument makes it harder to challenge and justifies a written request for confirmation.
The procedure then depends on the consequences of the measure. Under Article 64 of the General Statute, the opinion of the Joint Administrative Committee is required for a compulsory transfer entailing a change of residence. This opinion does not necessarily mean that the committee decides in place of the administration, but failure to obtain it may constitute a material procedural defect. In practice, you should request the date on which the committee was consulted, an extract from the minutes, and details of its composition, rather than asserting without evidence that it was never consulted.
Law No. 03-01 on the requirement to state reasons for certain adverse individual administrative decisions does not automatically require reasons to be stated for every ordinary transfer. It applies when the decision falls within one of its categories, particularly where it imposes a penalty, restricts a freedom, or derogates from general rules. A transfer alleged to be disciplinary, discriminatory, or derogatory must therefore be closely examined. Even where there is no formal requirement to state reasons, the administration will have to explain to the court the service requirements on which its decision was based.

How to prove that a transfer or assignment is abusive
lack of authority to make transfer decision
This ground is established when the signatory had neither the required authority nor a valid delegation.
procedural defect in transfer
Failure to conduct a mandatory consultation may result in annulment if it deprived the employee of a safeguard or influenced the decision.
manifest error of assessment in transfer
This concerns a decision that is manifestly disproportionate or inconsistent with the employee’s grade, the position, and the stated requirements.
misuse of power in transfer
Consistent evidence must show that the transfer pursues a personal or punitive objective, or one unrelated to the service.
transfer in retaliation for trade union activity
The chronology, written threats, comparative treatment, and lack of a genuine need may reveal retaliation.
An action for abuse of power traditionally relies on several grounds: lack of authority, a formal or procedural defect, violation of the law, error of fact, manifest error of assessment, and misuse of power. Lack of authority can often be verified through the instruments of delegation. A procedural defect may arise from the failure to obtain the opinion of the Joint Administrative Committee where Article 64 requires it. A violation of the law may occur, for example, where the administration disregards a safeguard contained in the employee’s special statute.
A manifest error of assessment concerns a decision whose consequences appear manifestly disproportionate to the stated requirements. However, the mere distance of a position does not make it unlawful, and the administrative court does not replace the administration in organising the service. The case is stronger where the position is incompatible with the employee’s grade, does not actually exist, carries no duties, or where equivalent positions were available and no objective reason explains the contested choice.
Misuse of power is alleged when a transfer is used to punish trade union activity, a lawful strike, whistleblowing, or a personal dispute. This ground is difficult to establish because the true intention is rarely recorded in writing. A body of supporting evidence must be assembled: the close timing between the dispute and the transfer, emails, threats, differences in treatment, the absence of any need at the receiving location, and immediate replacement in the former position. A trade union statement alone is helpful but is rarely sufficient without consistent objective evidence.
Administrative and hierarchical appeals against a transfer
administrative appeal against transfer
An administrative appeal asks the authority that made the decision to withdraw, amend, or reconsider it.
hierarchical appeal against assignment
A hierarchical appeal is submitted to the superior of the decision-maker where the administrative structure permits.
60-day deadline to appeal transfer
Administrative or judicial proceedings must, in principle, be initiated within the sixty-day period provided for in Article 23.
administrative silence after appeal
After sixty days of silence, the person concerned generally has a new sixty-day period in which to apply to the court.
proof of filing administrative appeal
A receipt from the registry office or postal acknowledgement of receipt proves the date and content of the appeal.
An administrative appeal is submitted to the authority that made the decision, whereas a hierarchical appeal is submitted to that authority’s superior where such a superior exists. For an ordinary action for abuse of power, this step is not systematically mandatory: Article 23 of Law No. 41-90 allows a direct application to the Administrative Court within the statutory time limit. It may, however, be required by special legislation or may be useful for obtaining a prompt reconsideration, supplementing the reasons given, and preserving the possibility of an internal solution.
The administrative appeal must be filed within sixty days of the publication or notification of the contested decision. Where it is duly submitted within that period, Article 23 then allows an application to be made to the court within sixty days of notification of the rejection. If the administration remains silent for sixty days, that silence constitutes rejection for the purpose of calculating the new time limit for judicial proceedings. The date of notification and the expiry date are determined under the procedural rules for calculating time limits; it is always preferable not to wait until the final days.
The letter must state the employee’s identity, administrative number, grade, current assignment, the reference of the decision, and the specific amendments requested. It should set out the facts in chronological order, followed by the legal grounds and corresponding supporting documents. File it with the registry office in exchange for a dated receipt or send it by registered post with acknowledgement of receipt. Email alone is risky where no reliable electronic acknowledgement exists. Taking up the new post while reserving one’s rights does not, by itself, amount to waiving the right of appeal.
Stay of execution and urgency: can the transfer be blocked?
stay of transfer in Morocco
The principal legal remedy is the exceptional application for a stay of execution provided for in Article 24 of Law No. 41-90.
urgency of civil servant transfer
Urgency must be demonstrated by serious, imminent, and difficult-to-repair harm, not mere inconvenience.
serious ground for annulment of transfer
An apparent lack of authority, an omitted mandatory consultation, or an inconsistent case file may support the application for a stay.
suspensive effect of transfer appeal
An administrative appeal and an action for annulment do not suspend the decision without a court order.
taking up position and appeal
Implementing the transfer does not generally prevent it from being challenged if the appeal was filed within the statutory time limit.
An action for annulment does not automatically suspend the transfer. However, Article 24 of Law No. 41-90 authorises the Administrative Court, when hearing an application for annulment, to order a stay of execution on an exceptional basis if the applicant expressly requests it. Technically, this application for a stay should not be confused with every form of interim proceedings. Depending on the precise purpose of the application, a provisional measure may also fall within the urgent jurisdiction governed by Article 19 of the same law and the Code of Civil Procedure.
In practice, you must demonstrate specific urgency and present a serious ground challenging the lawfulness of the decision. Family separation, interruption of medical treatment, loss of official accommodation, or an immediately irreversible assumption of duties may establish urgency, but no circumstances guarantee a stay. The court also weighs the continuity of the public service. The submissions should therefore explain why a temporary stay would not disrupt the service or why a less harmful solution remains available.
The application must be filed promptly, preferably before the date on which the new position is to be taken up, either with the main application or afterwards while the dispute remains pending. Time frames vary considerably according to the urgency demonstrated and the court’s caseload: a decision may be issued within a few days or several weeks. Until an order suspends the measure, the civil servant should avoid abandonment of post. The civil servant may comply with the transfer while maintaining the appeal, unless particular circumstances need to be examined with legal counsel.
Action for annulment before the administrative court
action for annulment of transfer
This action asks the administrative court to annul retroactively an unlawful transfer.
60-day administrative court deadline
Article 23 requires, in principle, proceedings to be brought within sixty days of publication, notification or the decision rejecting the claim.
lawyer required before administrative court
The application must, in principle, be signed by a lawyer admitted to the Bar, pursuant to Article 3 of Law No. 41-90.
cost of challenging transfer in Morocco
An action for annulment is exempt from court fees, but lawyers’ fees and copying costs remain payable.
court with jurisdiction over civil servant transfer
Territorial jurisdiction must be determined in light of Article 10, the place of assignment and the authority concerned.
Articles 20 to 24 of Law No. 41-90 govern actions seeking the annulment of an administrative decision for abuse of power. The application must identify the decision, set out the facts, present the grounds of unlawfulness and clearly state the request for annulment. Under Article 3, it must, in principle, be made in writing and signed by a lawyer admitted to a Moroccan Bar, subject to statutory exceptions. Article 22 exempts actions for annulment for abuse of power from court fees: the claim that a fixed 100-dirham stamp duty applies is therefore incorrect for this action.
The standard time limit is sixty days from publication or notification of the decision, pursuant to Article 23. Informal knowledge does not always replace proper notification, but waiting for a second letter remains risky when the decision has already been delivered and implemented. If no written document has been provided, evidence of the measure should be retained: an order to report for duty, a record of delivery, a posted notice, an institutional email, a change in the management application or deductions linked to the new position.
Territorial jurisdiction is determined under Article 10 of Law No. 41-90 and the rules of the Code of Civil Procedure to which it refers, with special provisions for certain civil service disputes. Proceedings should therefore not automatically be brought before the court of the civil servant’s place of residence or invariably before the court where the ministry’s national headquarters are located. Following the exchange of written submissions and production of the file by the administration, a judgment on the merits may take approximately eight to twenty-four months, depending on the court and any procedural issues. Appeals are heard by the administrative court of appeal with jurisdiction.
Documents to gather and contents of the case file
copy of transfer decision
A full copy and proof of its notification identify the measure and allow the appeal period to be calculated.
civil servant appointment order
The appointment or assignment order establishes the employee’s grade, cadre and reference position.
evidence of abusive transfer
Emails, threats, timelines and comparisons of treatment are more useful than mere general allegations.
medical certificate for transfer
The certificate should describe the relevant medical constraints without unnecessarily disclosing the entire medical record.
documents for administrative challenge to transfer
The challenge should be accompanied by the decision, statutory documents and supporting evidence corresponding to each argument.
The case file begins with the full version of the contested decision, together with its notification date. Add the appointment order, the most recent assignment decision, documents establishing the grade, cadre and seniority, and the provisions of the special statute. If the decision has never been delivered, request a copy in writing and attach evidence indicating that it exists. Proof of the administrative challenge, its acknowledgement of receipt and any response must be retained in its original form.
Personal documents must establish specific harm without turning the challenge into a mere request for favourable treatment. A medical certificate detailing follow-up care constraints, birth certificates, school attendance certificates, proof of the spouse’s employment or documents concerning a dependent ascendant may support urgency and proportionality. In the case of a disguised disciplinary measure, gather summonses, requests for explanations, professional correspondence, trade union reports and comparative evidence. Medical data must be limited to what is necessary for the proceedings.
An administrative challenge may follow a simple structure: identification of the employee, subject matter, chronological background, reference to the decision, legal grounds, specific consequences and final request. Depending on the circumstances, request specifically the withdrawal of the decision, its revocation for the future, reassignment or reconsideration. Vague wording merely asking for understanding weakens the letter’s legal effect. Number the documents, prepare a schedule of exhibits and retain an identical copy of the filed case file, including the envelope and postal acknowledgement of receipt.
Special cases: teachers, local authorities, police and judges
teacher transfer in Morocco
The case file must combine the special statute for education personnel, the rules governing the AREFs and the circular for the relevant transfer round.
Moroccan municipal civil servant transfer
The legally competent authority must be identified based on the local authority concerned and the delegations currently in force.
police transfer in Morocco
National Security personnel are governed by a special statute that takes account of specific security requirements.
transfer of judges in Morocco
Transfers of judges are governed by the Organic Law on their statute and the powers of the Supreme Council of the Judicial Power.
special statute for civil servants
A special statute may supplement or displace certain rules of the General Statute of the Civil Service.
For teachers, the exact employer and the applicable legislation must be identified before drafting the challenge. The Regional Academies for Education and Training (AREFs) are governed by Law No. 07-00, as amended in particular by Law No. 71-15. Education personnel are also governed by the special statute established by Decree No. 2-23-819 of 6 October 2023, as amended. National or regional transfer rounds are also governed by annual circulars and procedures: the points system, family reunification and seniority must be checked against the rules for the relevant campaign.
Civil servants employed by local authorities must not confuse the president of the elected council, the authority responsible for administrative management and the supervisory authority. Their position depends in particular on the organic laws relating to local authorities, including Organic Law No. 113-14 on municipalities, as well as the statutory provisions applicable to municipal personnel. For the police, Royal Decree No. 2-66-492 of 21 October 1966 establishing the special statute for National Security civil servants, as subsequently amended, requires account to be taken of the constraints specific to this corps.
The transfer of judges is governed by a separate regime. Organic Law No. 106-13 on the Statute of Judges and Organic Law No. 100-13 on the Supreme Council of the Judicial Power govern appointments, transfers and the corresponding safeguards. For the Royal Armed Forces and other corps governed by special statutes, ordinary remedies cannot be applied mechanically. The sixty-day time limit remains an essential benchmark, but the competent authority, required consultations and, in some cases, the court with jurisdiction must be verified for each corps.
Costs, time limits, common errors and the lawyer’s role
administrative lawyer fees in Morocco
First-instance proceedings often cost between 3,000 and 10,000 dirhams depending on complexity, with no mandatory national fee scale.
court fees for action for annulment
Article 22 of Law No. 41-90 exempts actions for annulment for abuse of power from court fees.
missed transfer challenge deadline
A challenge filed out of time may be declared inadmissible even if the substantive arguments appear serious.
legal aid for civil servants
An employee with insufficient means may submit an application to the competent legal aid office.
administrative law lawyer in Morocco
The lawyer safeguards compliance with the deadline and territorial jurisdiction, proves the defects and, where appropriate, applies for a stay of execution.
Actions for annulment for abuse of power are exempt from court fees under Article 22 of Law No. 41-90. The main costs therefore concern lawyers’ fees, copies, any translations, formal reports and travel. In 2026, first-instance fees are freely agreed and often range from 3,000 to 10,000 dirhams for a case of ordinary complexity, depending on the Bar, urgency and volume of documents. This range is based on professional practice, not on a mandatory national fee scale. Legal aid may be requested where the applicant has insufficient means.
The most serious error remains missing the sixty-day deadline. Other errors include choosing a court that lacks territorial jurisdiction, failing to provide proof of notification, confusing an optional administrative challenge with a mandatory prior challenge required by special legislation, or filing an application for suspension without a main action. Another pitfall is relying solely on family circumstances. These circumstances deserve consideration, but they are not always sufficient when faced with a demonstrated operational need. The facts must be linked to an illegality that the court can review.
The lawyer checks the applicable statute, the signatory’s delegated authority, the procedure followed, calculation of the time limit and the court with jurisdiction. The lawyer may request disclosure of the administrative file, organise the evidence, draft the application and seek a stay of execution where justified by urgency. No serious professional can promise annulment: the administration retains significant organisational discretion. Even after annulment, it may sometimes issue a new decision that complies with the rules on authority and procedure, provided that it does not disregard the binding effect of the judgment.
What is the time limit for challenging a transfer in Morocco?
Article 23 of Law No. 41-90 establishes, in principle, a sixty-day time limit from the publication or notification of the decision. An administrative or hierarchical appeal lodged within this period allows the matter to be subsequently brought before the court within sixty days of an express rejection. Failure to respond for sixty days is deemed a rejection for the purpose of calculating this period. A late application may be declared inadmissible without any examination of the legality of the transfer.
How do you draft an administrative appeal against an abusive transfer?
The appeal must be addressed to the authority that issued the decision and must specify the applicant’s identity, grade, position, the reference of the instrument and the date of notification. Present the facts chronologically, followed by each irregularity and the document proving it. Clearly request the withdrawal, amendment or reconsideration of the transfer. File the letter with the registry office against a receipt or send it by registered mail with acknowledgment of receipt.
What grounds may lead to the annulment of an assignment?
The main grounds are lack of authority of the signatory, a defect of form or procedure, violation of the law, error of fact, manifest error of assessment and misuse of power. Failure to obtain the opinion of the Joint Administrative Committee may be decisive where a compulsory transfer entails a change of residence within the meaning of Article 64. A punitive transfer may also be challenged as a disguised disciplinary sanction. The ground must always be supported by specific evidence.
Can a transfer be suspended before taking up the new post?
Yes, but an appeal does not automatically suspend the decision. Article 24 of Law No. 41-90 allows the Administrative Court, exceptionally, to order a stay of enforcement where an application for annulment has been filed. A specific urgency must be established and serious grounds of illegality must be presented. Until a judicial decision has suspended the transfer, the public official must avoid being considered to have abandoned their post.
What documents are required to challenge a transfer?
You must provide the contested decision, proof of its notification, the appointment and assignment orders, documents relating to the grade, and the applicable special regulations. Add proof of the administrative appeal, professional correspondence, and any relevant medical or family supporting documents. In the event of a disguised disciplinary sanction, include any threats, summonses, emails and available comparative evidence. The documents must be numbered and accompanied by a schedule of exhibits.
Can the Administrative Court annul a transfer?
Yes, a transfer may be annulled if it is vitiated by lack of authority, a substantial procedural defect, a violation of the law or a demonstrated misuse of power. However, the judge does not decide which assignment would be best and respects the administration’s organisational authority. Following annulment, the administration must give effect to the judgment. It may sometimes issue a new decision that is lawfully reasoned and properly adopted.
What is the difference between an administrative appeal and a hierarchical appeal?
An administrative appeal is addressed to the authority that issued the transfer itself. A hierarchical appeal is submitted to the higher authority where one exists and has the power to reconsider the decision. They are not systematically mandatory before bringing an application for annulment for abuse of power, unless otherwise provided by a specific legal text. In both cases, dated proof of filing must be retained and the time limit following rejection must be monitored.
What rights does a public official transferred far from their family have?
Distance or family separation does not automatically make the transfer unlawful. However, the public official may request reconsideration, rely on Article 64 where its conditions are met, and provide specific supporting documents concerning children, a spouse, health issues or a dependent person. The public official may also claim the allowances provided for under the legal texts applicable to travel or changes of residence. If the harm is serious and immediate, an application for a stay may accompany the application for annulment.
How much does it cost to challenge a transfer in Morocco?
An application for annulment for abuse of power is exempt from court fees under Article 22 of Law No. 41-90. Lawyers’ fees are freely determined and often range from 3,000 to 10,000 DH at first instance for a standard case, depending on the region and complexity. Costs for copies, translation, official reports or travel may be added. Legal aid is available subject to financial eligibility requirements.
Challenging an employment transfer decision in Morocco: which court has jurisdiction?
The Administrative Courts, established under Law No. 41-90, have jurisdiction over applications to annul employment transfer decisions on the grounds of abuse of power. Territorial jurisdiction is determined in accordance with Article 10 of the same law and the rules of civil procedure, taking into account the place of work and the administrative authority concerned. The time limit for bringing an application is, in principle, sixty days from the date on which the decision is published or notified. The special regulations governing the public official must be checked because certain categories are subject to specific rules.
An administrative law lawyer can check the time limit, the applicable regulations, the signatory’s authority and whether an appeal or application for a stay is appropriate. Consult a lawyer practising in this field on AvocatLib.
