Deadline: a court action for dismissal must be filed within 90 days of receiving the dismissal decision (art. 65 of the Labour Code).
Gross misconduct: the employer must follow the hearing procedure within eight days (art. 62); a breach makes the dismissal unfair.
Severance pay (art. 53): 96 hours of salary per year for the first five years, then 144, 192 and 240 hours depending on seniority.
Unfair dismissal (art. 41): damages of one and a half months’ salary per year of seniority, capped at 36 months. Our calculator gives the order of magnitude.
What should I do in the days after a dismissal in Casablanca?
Keep the dismissal letter and its receipt date, gather the contract, payslips and certificates, then consult quickly: the 90-day deadline to go to court runs from receipt of the decision. A claim before the Casablanca labour inspectorate can precede the court action.
What is the difference between severance pay and damages?
Severance pay is owed to any employee dismissed without gross misconduct after six months’ seniority, on an hourly scale. Damages are added when the dismissal is ruled unfair, at one and a half months per year, capped at 36 months.
How much does an employment lawyer cost?
Fees are unregulated; many Casablanca lawyers offer a flat fee for conciliation and a success component for litigation. Ask for a written agreement and check whether your insurance or union covers part of the costs.
