What to know before you consult

A residential lease must be in writing (Law 67-12); the move-in inventory protects both parties when the deposit is returned.
Rent review (Law 07-03): at most 8% for housing and 10% for professional use, every three years, unless agreed otherwise.
Unpaid rent: formal notice, then action before the first-instance court; eviction is only possible by court decision.
Commercial lease (Law 49-16): the right to renewal and the eviction compensation follow strict conditions of duration and form.

Frequently asked questions

My tenant stopped paying: how long to evict in Marrakech?

After a formal notice without effect, the action goes before the Marrakech first-instance court. Depending on the procedure and the court’s workload, expect several months between the summons and the enforcement of the judgment. Evicting without a court decision exposes the landlord to prosecution.

Can the landlord keep the security deposit?

Only to cover unpaid rent or damage established against the move-in inventory. Without an inventory, the retention is hard to justify; a lawyer can obtain restitution before the court.

Do I need a lawyer for a tenancy dispute?

For a formal notice or a negotiation, a consultation is often enough. Once court proceedings start, representation by a Marrakech lawyer secures deadlines, evidence and enforcement of the judgment.
