Child support in Morocco, known as nafaqa or النفقة, is a family obligation intended to meet the needs of a person who cannot provide for their own maintenance. It therefore does not concern only children after a divorce. Article 187 of the Family Code recognizes three grounds for a maintenance obligation: marriage, kinship, and an undertaking. The applicable rules are set out in Articles 187 to 205 of Law No. 70-03, promulgated by Dahir No. 1-04-22 of February 3, 2004.

Article 189 defines maintenance broadly. It includes food, clothing, medical care, children’s education, and everything considered essential by custom. Housing is also an essential item. In practice, a judgment may set monthly maintenance, a housing contribution, school expenses, remuneration for custody or breastfeeding, and specific healthcare costs. The operative part must be read line by line because each amount has its own beneficiary, starting date, and enforcement terms.

The amount is set according to the debtor’s means and the beneficiary’s needs. This rule does not allow the debtor to conceal an activity, artificially transfer income, or claim to have no resources while maintaining a high standard of living. The court may examine salary, benefits declared to the CNSS, professional or rental income, known assets, and essential expenses. Where evidence is contradictory, Article 190 allows judicial assessment of the documents and, if necessary, an expert assessment.

Nafaqa must not be confused with mut’a. Provided for notably by Article 84 for certain divorces, mut’a is compensation assessed according to the duration of the marriage, the husband’s financial situation, the reasons for the separation, and the degree of responsibility for the divorce. It is neither lifetime monthly maintenance nor child support. Custody, known as hadana, likewise does not transfer to the custodial parent the primary maintenance obligation owed by the other parent.

During marriage, the wife’s maintenance is governed primarily by Articles 194 to 196 of the Family Code. The right requires a valid marriage and is assessed in light of the actual marital situation. When the husband stops contributing to household expenses, the wife may bring an action without waiting for a divorce, even if the spouses live separately. The starting date of the amounts claimed must be stated and supported by discontinued transfers, messages, a formal demand, or any other evidence showing that payments actually ceased.

After divorce, several rights must be distinguished: any maintenance owed during the statutory waiting period, housing, previous arrears, the children’s rights, and the mut’a under Article 84. The Moudawwana does not establish general lifetime maintenance for the former wife. Pregnancy during the statutory waiting period may alter the duration of certain rights. In practice, every agreement must specify the nature of each payment, its duration, its beneficiary, and the date on which it becomes due.

Children’s maintenance is governed primarily by Articles 198 to 202. Article 198 provides that the father maintains his children until they reach the age of majority and, for those continuing their studies, until they reach the age of 25. This age limit appears in the published text, but its application depends on whether the studies are genuine: mere enrollment without attendance may be challenged. For a daughter, the right continues until she has sufficient resources or until her husband becomes legally responsible for her maintenance.

The full rule is as follows: where a child with a disability or incapacity cannot obtain resources that would allow the child to meet their own needs, the father must continue providing maintenance, and reaching the age of majority alone does not automatically end it. The court may request a recent medical certificate, hospital records, an administrative disability decision, and evidence of expenses. It specifically assesses the connection between the health condition, inability to work, and lack of resources.

If the father is totally or partially unable to pay and the mother is solvent, Article 199 provides for her contribution in proportion to her means. This does not mean an automatic equal split. The judge takes into account expenses already paid directly by the custodial mother. Ascendants in need may, for their part, bring an action against their descendants under Articles 203 to 205; where several children are solvent, the contribution is allocated according to their resources and not necessarily in equal shares.

There is no national minimum amount or automatic percentage of salary. Article 189 requires the judge to take into account, with moderation, the debtor’s income, the beneficiary’s circumstances, the cost of living, and the customs of the social environment. Article 190 allows the judge to compare the parties’ statements with the evidence. Two families with the same number of children may therefore receive different amounts because of rent, the city, education, health, or their previous standard of living.

The most useful documents for establishing resources are payslips, an employment certificate, CNSS statements, tax returns, lease agreements, and documents relating to a commercial activity. An extract from the Commercial Register or information available through OMPIC may clarify a company director’s situation. If the debtor claims to be unemployed, objective evidence concerning vehicles, real property, spending, or actual activity will be more persuasive than mere statements or isolated photographs.

Needs must be quantified item by item. The case file may contain the lease, receipts, school invoices, transport costs, prescriptions, pharmacy invoices, and childcare expenses. The court does not necessarily add up all invoices because some benefit the entire household. A clear claim therefore distinguishes ordinary monthly maintenance, housing, education, exceptional healthcare, custody, and arrears, with a total for each child and each period.

For purely indicative purposes, published or reported practice before the Courts of First Instance in Casablanca and Rabat shows maintenance awards of a few hundred dirhams per month per child where income is modest. For a parent with a comfortable income, where expensive housing or justified private schooling is involved, the contribution may reach or exceed 2,000 DH per child, excluding housing. This range is neither an official scale nor a prediction of the outcome; it depends on the evidence and the date of the decision.

Housing is often the main source of disagreement. The father remains required to contribute to housing the children even where their mother owns her home or is accommodated by her family, but the judge assesses the expense actually incurred and the living arrangements. Private school fees are not systematically charged to him in full. The court examines whether this choice corresponded to the family’s standard of living before the separation, whether it serves the child’s interests, and whether the available resources allow it to continue.

The claim is filed with the Court of First Instance, Family Justice Division. For a standalone maintenance action, territorial jurisdiction may generally be based on the defendant’s domicile or the maintenance creditor’s residence, in accordance with the rules of the Code of Civil Procedure applicable to the claim. Where nafaqa is claimed as part of divorce proceedings, it is handled by the court hearing the matrimonial case. Where there are multiple addresses or residence abroad, jurisdiction must be verified before filing.

The application identifies the parties, their full addresses, the family relationship, the date payments ceased, and each amount claimed. It distinguishes current maintenance, housing, education, healthcare, custody, and arrears. The national identity card, marriage certificate, birth certificates, school certificate, and financial supporting documents are generally attached. Foreign documents may need to be apostilled or legalized depending on their country of origin and then translated into Arabic by a sworn translator.

After registration, the court registry issues a case number and sets a hearing date. An incomplete or outdated address is a frequent cause of delay because the defendant must be duly summoned. The judge hears the parties, receives their documents, and may request an investigation, expert assessment, or additional supporting documents. The Mahakim Portal generally allows hearings to be tracked, but only the full judgment, particularly its operative part, identifies the amounts, starting dates, and enforcement measures granted.

Article 190 provides that the court must rule on maintenance claims within a maximum period of one month. This statutory period may be exceeded where service fails, income remains difficult to establish, or an evidentiary measure is required. Article 193 makes maintenance decisions enforceable notwithstanding avenues of appeal. In practice, an appeal does not release the debtor from paying the amount awarded until the decision has been varied, set aside, or replaced.

During divorce proceedings, Article 121 authorizes interim measures concerning the wife, the children, and their housing where cohabitation becomes impossible. For a standalone claim, the urgency must be described and supported by evidence: a total lack of resources, risk of eviction, medical costs, or interruption of schooling. The requested measure must be expressly stated. The judge is not required to reconstruct an imprecise claim or independently award every possible item.

Ancillary costs include copies, translations, service, address searches, expert assessments, and enforcement measures. Their amount depends on the regulated fee for the measure, travel, and the number of recipients. A service or enforcement measure often costs a few hundred dirhams, but this range derives from professional practice rather than a national flat fee. The exact amount must be requested from the court registry, judicial enforcement officer, or relevant professional, together with a receipt and an itemized statement of disbursements.

A lawyer is not systematically mandatory for a straightforward family claim at first instance. In practice, fees observed in 2026 often range from 2,500 to 8,000 DH, depending on the city, hearings, evidentiary difficulties, and whether enforcement is involved. No mandatory national tariff sets these fees. A written fee agreement should specify whether service, the appeal, the criminal complaint, and attachments are included or billed separately.

After judgment, several more weeks may be required to obtain the enforceable copy, serve the decision, and open the enforcement case. The creditor will save time by providing the workplace address, the employer’s identity, the known bank, and the details of a vehicle or real property. The Enforcement Department cannot instantly locate concealed assets. A bank attachment requires identification of an institution likely to hold funds, while attachment of real property is longer and more expensive. In practice, regular deductions through a stable employer often remain the most effective way of limiting further non-payment.

Non-payment may also constitute family abandonment under Article 480 of the Criminal Code, whose wording must be read in its consolidated version following amendments made after 2004, notably those associated with Laws No. 03-07 and No. 79-14. The offence requires maintenance awarded by an enforceable decision, intentional non-payment for more than two months, and the prior formal demand required by the procedure. According to the practice of trial courts, the validity of this formal demand and proof of its receipt are strictly examined.

The formal demand for criminal purposes is not the same as a private letter or telephone message. It is made under the procedure implemented under the authority of the Public Prosecution Office, generally by a judicial police officer, to invite the debtor to pay within the statutory period. The complaint may be filed with the Public Prosecutor at the Court of First Instance, the judicial police, or the Royal Gendarmerie, together with the judgment, proof of service, the statement of account, and enforcement reports. A criminal conviction does not extinguish civil arrears.

The Family Solidarity Fund assists certain categories defined by law where enforcement is impossible or delayed, notably due to the debtor’s absence, insolvency, or disappearance. References No. 42-10 and No. 79-14 must be compared with their publication in the Official Gazette and the applicable consolidated version, as numbering discrepancies appear in several unofficial commentaries. The maintenance amount is not permanently fixed. Article 192 of the Family Code allows it to be reviewed where the debtor’s or beneficiary’s circumstances change. A new application is normally admissible only after one year has elapsed since the amount was set, except in exceptional circumstances. This rule prevents repeated proceedings based on minor variations. A serious illness, sudden loss of employment, or a substantial and lasting increase in the child’s needs may nevertheless justify an earlier application.

To obtain an increase, the beneficiary must establish new needs or an improvement in the debtor’s means. A new lease, school enrollment, ongoing healthcare, a documented increase in expenses, or proof of a professional promotion may be produced. A general reference to inflation is not always sufficient. The applicant must compare the budget presented at the time of the first judgment with the current situation and explain the specific effect of each additional expense.

A debtor seeking a reduction must prove a genuine, involuntary, and sufficiently lasting decrease in resources. A voluntary resignation, transfer of a business activity to a relative, or accumulation of personal loans does not automatically justify a reduction. The court examines other income and assets that can be used. Until a new decision is issued, the previous amount remains payable; unilaterally reducing transfers creates arrears that may be subject to compulsory enforcement and, where the conditions are met, criminal prosecution.

The review application is filed with the competent Family Justice Division, together with the initial judgment and new documents. The decision specifies the effective date of the new amount, often linked to the date of the court application depending on the circumstances accepted. Waiting several months may therefore be costly. The parties may negotiate an adjustment, but a verbal arrangement remains precarious. Judicial approval of a written agreement clarifies its duration and provides an enforceable instrument.

For a son, Article 198 provides in principle for maintenance until the age of majority, or until the age of 25 where he continues his studies. For a daughter without resources, maintenance continues until she can meet her own needs or her husband becomes responsible for it. A child unable to earn a living because of a disability remains protected.

The debtor should not unilaterally stop payments while a judgment remains enforceable. If the conditions no longer apply, the prudent course is to ask the court to declare the obligation terminated or to review the decision. This precaution is particularly useful where an adult child has completed their studies, works occasionally, or follows an irregular course of study. Without a new decision, the Enforcement Department may continue to record monthly installments and initiate an attachment on the basis of the existing enforceable instrument.

The custodial mother’s remarriage does not extinguish the children’s maintenance because they are the beneficiaries. It may raise separate custody issues under the restrictive conditions of the Moudawwana, without automatically releasing the father from his maintenance obligation. If the debtor dies, installments already due constitute a debt that may be declared against the estate. The children’s future needs must be analyzed in light of family law, succession rules, and their financial circumstances.

Where the debtor lives outside Morocco, a Moroccan court may rule if its international and territorial jurisdiction is established. To attach salary or a bank account abroad, the judgment must generally obtain exequatur or recognition under local law. Applicable bilateral conventions may facilitate service and the circulation of decisions. The case file usually includes the judgment, a certificate of no appeal or information concerning the appeal, proof of service, a sworn translation, and, depending on the country, an apostille or legalization.

The first mistake is to claim a lump sum without a budget or proof of resources. The judge may then award a cautious amount that does not reflect the actual circumstances. Another mistake is to omit housing, arrears, education, custody, or healthcare. The court rules on the claims submitted to and argued before it. Before filing, every beneficiary, period, and expense must therefore be clearly stated in the application and in a consistent calculation table.

Many creditors wait for the outcome of the appeal before taking action, even though Article 193 makes the maintenance decision enforceable notwithstanding appeals. Others apply directly to the Family Solidarity Fund without a report establishing failed or delayed enforcement. The file is then returned for rectification. Cash payments without a receipt also cause disputes: a bank transfer must state the relevant month, and every payment made in person must be acknowledged by a dated and signed receipt.

Confusion between nafaqa, mut’a, and the former wife’s rights leads to inaccurate calculations. The mut’a under Article 84 relates to the dissolution of marriage and is not a monthly maintenance payment. Child support legally belongs to the child, even when paid to the custodial parent. That parent therefore cannot, in their own name alone, permanently waive the child’s future rights. An agreement may organize payments, but the judge retains oversight based on the child’s best interests.

A lawyer can determine the competent court, verify any limitation period raised against certain claims, identify evidence of income, and quantify the various items. Legal assistance is particularly useful where the debtor manages a business, owns real property, works without a declared salary, resides abroad, or is subject to a criminal complaint.
