Unopened AMO rights are often discovered during hospitalization, at the pharmacy, or after submitting a medical claim form. In practical terms, having a CNSS number is not enough. Registration permanently identifies the employee, while eligibility for benefits depends on their circumstances, the declarations recorded, and the conditions established by Law No. 65-00 on the Basic Medical Coverage Code.
The most common cause remains the absence of recent declarations. The employer may have omitted an employee, declared too few days, or stopped completing the required formalities after termination of the employment contract. An allocation delay may also occur after an employer payment. Each relevant month must therefore be examined, rather than merely producing an employment certificate or a payslip containing a CNSS entry.
The blockage may also result from an incorrectly recorded change in circumstances. This can occur after starting a new job, becoming self-employed, retiring, marrying, or a change concerning a child. A discrepancy in the name, CIN, or date of birth may prevent the records from being matched. Caution: a civil-status document provided to the employer is not necessarily registered with the managing body.
For a public-sector employee, the message “CNOPS rights not open” may result from a payroll deduction that has not been matched or from an incomplete family file. Law No. 54-23 provided for the transfer of public-sector AMO management to CNSS. In practice, during the transfer process, you must identify the managing body shown on the certificate and check the official instructions applicable to the file in 2026.
The scheme is based primarily on Law No. 65-00, promulgated by Dahir No. 1-02-296 of October 3, 2002. Article 11 generally makes the employee's initial eligibility for benefits conditional on 54 contribution days within a maximum period of six consecutive calendar months. This rule must be applied to the relevant period, using the declarations actually linked to the insured person's account.
The 54-day threshold must not be confused with the conditions governing daily sickness or maternity benefits. These social security benefits have their own rules. The formula of 108 days over twelve months, sometimes circulated online, does not replace the general condition under Article 11. In the event of a refusal, ask CNSS for the reference period and the precise calculation it applied.
Law No. 65-00 also provides for a temporary continuation of rights after compulsory coverage ends, particularly in certain situations involving job loss, divorce, or death. The duration depends on the legal circumstances and should not be estimated orally. Request a dated certificate covering the period of care. After starting a new job, the new employer's declarations must then be correctly linked to the same CNSS number.
Professionals, self-employed workers, and persons engaged in a liberal profession are governed by Law No. 98-15. Their rights depend on their professional category, registration, and payment of contributions due. A person may remain visible in the database while their rights are suspended. Regularization must then be completed with CNSS according to the declared activity, without falsely reporting a cessation of activity or another category.

Start with the MaCNSS portal or application. Check wage declarations, the number of days, beneficiaries, and the processing status of AMO files. Damancom is mainly used by employers and their representatives; it is not the employee's standard portal. To recover access, prepare your registration number, CIN, and the contact details previously provided to CNSS.
Review the period corresponding exactly to the refused care, then go back at least six months. Download the available statements or take dated screenshots. An active status displayed today does not necessarily prove that rights were open on the date of an earlier consultation. Conversely, a currently closed status does not rule out the possibility that an earlier period was properly covered.
If the data are incomplete, visit a branch with the relevant original documents and copies. Request a declaration statement, a certificate of rights, and the precise reason for the blockage. An oral explanation given at the counter will be difficult to produce before a court. Therefore, submit a written request, obtain a receipt, and record the date and reference assigned to the file.
For a civil servant, the verification process also begins with the human resources department. It should be able to trace payroll deductions and the information transmitted to the managing body. If CNOPS and CNSS refer the file back and forth during the transfer provided for by Law No. 54-23, send a written complaint to both bodies. Attach the administrative response to identify the stage at which the affiliation was interrupted.
When salaries have been declared but the rights remain closed, submit a reconciliation request to CNSS. Specify the period of care and the months to be corrected. Provide a simple table comparing the days worked with those shown on the statement. A targeted request allows the relevant department to identify more quickly an allocation error, duplicate registration, or unallocated declaration.
If the employer has made no declarations, serve the employer with a formal notice. Articles 15 and 16 of Dahir-Law No. 1-72-184 of July 27, 1972, concerning the social security scheme govern employer affiliation and employee registration. Do not sign a document describing you as self-employed if you actually worked under the direction and control of a company.
At the same time, refer the matter to CNSS and the territorially competent Labor Inspectorate. CNSS has inspection powers and may assess the contributions due based on the information collected. The Labor Inspectorate may intervene within the limits of its powers and attempt conciliation. However, it does not replace the court when the employer denies the hiring, salary, or duration of the employment relationship.
If these steps fail, the social division of the Court of First Instance generally has jurisdiction pursuant to Article 20 of the Code of Civil Procedure. The claim may seek recognition of the employment relationship, social security regularization, and compensation for proven harm. Articles 77 and 78 of the Code of Obligations and Contracts may support the compensation claim if fault, damage, and a causal link are established.
The file should make it immediately clear who you are, when you worked, and why coverage should have been open. Keep the originals and submit itemized copies. The absence of a written contract does not necessarily prevent proof of salaried employment: depending on the circumstances, the court may examine several consistent indicators. Medical documents must link the refusal to a clearly identifiable date of care.
Family affiliation requires civil-status records that are consistent with the CNSS data. For a child who is a student or has a disability, the corresponding supporting document may be requested in accordance with the legal conditions. A document issued abroad may require an apostille or legalization, depending on the country, as well as a translation by a sworn translator. Check this requirement before paying for an unnecessary formality.
An administrative complaint is normally not subject to a filing fee. However, there may still be costs for copies, translation, registered mail, a bailiff, or a possible expert assessment. In 2026, fees observed in practice often range from 3,000 to 6,000 DH for an amicable intervention and from 6,000 to 15,000 DH for litigation, excluding taxes and disbursements. This is not a mandatory national fee schedule.
A purely administrative correction may take approximately two to six weeks. An employer inspection, a disputed retroactive declaration, or court proceedings often take several months and may exceed one year. These durations are practical estimates, not guaranteed time limits. Ask the court registry about the fees corresponding to the action actually brought and sign an agreement with the lawyer detailing fees, appeals, and disbursements.
Request a decision specifying the grounds, the date of treatment and the rule applied. The refusal may concern the opening of entitlements, but also an excluded procedure, a cap, prior authorization or late filing. These are not the same types of dispute. For a treatment form, immediately check the operational deadline stated on the form and by the CNSS, without waiting for a response to another complaint.
The challenge must be filed against an acknowledgment of receipt or sent by registered mail with acknowledgment of receipt. It must respond directly to the grounds relied upon and provide a brief chronology. Articles 42 and 44 of Law No. 65-00 do not establish a uniform sixty-day judicial time limit for every AMO refusal. The applicable time limit depends on the benefit sought, the authority that issued the decision and the chosen remedy.
Social security disputes generally fall within the jurisdiction of the social division of the Court of First Instance under Article 20 of the Code of Civil Procedure. Administrative Courts have jurisdiction, in particular, over the matters listed in Article 8 of Law No. 41-90. Where the matter involves an action for annulment of an administrative decision, Article 23 of that law provides, in principle, for a sixty-day period from its notification or publication.
Jurisdiction must be assessed before the time limit expires. A dispute against a private employer normally remains a social matter, whereas an act issued by a public-sector employer may require an administrative remedy. Keep the notification envelope and all dated evidence. In a medical emergency, interim proceedings may be considered, but they require concrete proof of the urgency and of the legal obligation invoked.
Registration and declaration are not optional. Articles 15 and 16 of Dahir enacting Law No. 1-72-184 impose social security formalities on employers subject to the scheme. A clause under which an employee waives CNSS coverage cannot override a mandatory public policy obligation. Nor are the company's size, the short duration of the contract or the parties' verbal agreement sufficient to exclude the statutory scheme.
The payslip must show social security deductions, but this entry does not prove that they were remitted. Regularly compare payslips with the MaCNSS statement, particularly after changing employers. If any months are missing, take action without waiting for the contract to end. A prompt formal notice facilitates inspection, preserves payroll records and helps identify the persons responsible who are still with the company.
If the employer denies that you worked there, gather evidence obtained lawfully and fairly. Do not access any messaging system without authorization and never alter a document. The court assesses the consistency of the case file as a whole, the reality of the instructions received and the conditions under which the work was performed. The Labour Inspectorate or the CNSS may gather evidence, but only the court with jurisdiction can finally decide a continuing dispute.
Regularization of declarations and compensation are two different claims. To obtain compensation, the employee must establish the expenses that remained payable by them or another loss directly caused by the employer's fault. Paid invoices, prescriptions and medical certificates are therefore essential. The amount is not automatic: it is assessed by the court in light of the evidence and the causal link.
RAMED was replaced by AMO Tadamon as part of the generalization process launched in December 2022. Ordinary renewal under the former RAMED rules is therefore no longer available. Targeting relies in particular on the National Population Register and the Unified Social Register, established by Law No. 72-18 on the system for targeting beneficiaries of social support programs.
AMO Tadamon is not a means of cancelling contributions owed under a contributory scheme. If a person is still recorded as an employee, self-employed person or self-employed entrepreneur, they must first have the relevant records corrected. Eligibility depends on household information and the socioeconomic threshold set by the applicable legislation. The former urban and rural RAMED thresholds must no longer be used.
Private insurance or a private mutual insurance scheme may supplement coverage but does not replace mandatory registration. Its cost depends on age, benefits, exclusions and the waiting period; no single price range is reliable. Before taking out coverage, read the terms concerning pre-existing conditions, maternity and hospitalization. Enrollment after treatment will generally not result in retroactive reimbursement.
In an emergency, go to the appropriate healthcare facility without waiting for administrative coverage to be reactivated. The hospital social services department can direct the patient to the mechanisms applicable to their situation. Keep the medical documents and proof of payment. The Tayssir program is not a health insurance scheme and does not reimburse treatment; it must therefore not be presented as an alternative to AMO.
The first error is making repeated visits to the service counter without obtaining anything in writing. The second is producing only a CNSS card when the issue concerns salary declarations. The third is submitting original invoices without an inventory. Every step must leave a dated record. Digitize the documents and keep the originals, particularly where the medical expenses are substantial.
Do not confuse failure to activate entitlements with a refusal to reimburse a medical procedure. In the first case, the issue concerns registration, contributions or status as an eligible dependent. In the second, coverage may be active, but the procedure may remain excluded, capped or subject to a prior formality. An imprecise complaint often receives a general response that does not address the actual issue.
Particular care must also be taken regarding the sixty-day period. The period under Article 23 of Law No. 41-90 concerns an action for annulment of an administrative decision; it does not automatically apply to every CNSS dispute. Other time limits may apply to the submission of treatment forms, benefits or claims against the employer. As soon as a refusal is issued, have the claim legally classified instead of waiting for informal discussions to conclude.
A lawyer is particularly useful where the employer disputes the contract, several years are missing or two organizations each refer responsibility to the other. The lawyer can prepare the formal notice, verify jurisdiction, preserve time limits and quantify the loss. Before the appointment, prepare a one-page chronology. The lawyer’s involvement does not guarantee the outcome, but it reduces the risk of proceedings being misdirected or incomplete.
